The caliber restriction — New Mexico's most unusual rule
Almost no other state does this, and it is the rule most likely to turn a licensed New Mexico carrier into an unlicensed one without them noticing.
A New Mexico CHL is not a general authorisation to carry a concealed handgun. The licence names the category and the caliber of handgun you qualified with during the live-fire portion of your training, and it authorises only that. Qualify with a 9mm semi-automatic and you are licensed for a 9mm semi-automatic — not for a .45, and not for a revolver. To add a category, or to move up in caliber, you must return and re-qualify.
New Mexico also limits a licensee to carrying one concealed handgun at a time. A backup gun carried concealed alongside your primary is outside the licence.
Training is correspondingly substantial — a 15-hour DPS-approved course covering conflict resolution, safe storage and state law, ending in the live-fire qualification that sets what your licence will say. Licences run four years for civilians and five for military.
Vehicles and open carry — where no licence is needed
New Mexico is more permissive than its "permit required" label suggests, because the licence requirement is narrower than in most permit states.
In a vehicle, no licence is required at all. You may carry a loaded handgun in a vehicle, concealed or in plain view, without a CHL. New Mexico's concealed carry statute reaches carrying concealed on your person; the vehicle exception is long-standing and explicit. The moment you step out with the handgun concealed on you, the licence requirement attaches.
Open carry needs no licence either, from age 19 — two years below the CHL age of 21. New Mexico's constitution protects the right to carry for lawful purposes and bars local governments from regulating it "in any way," so unlike Oregon or Washington there is no patchwork of city ordinances to track. Carrying concealed on foot without a CHL is a petty misdemeanor for a first offence. The penalties escalate sharply by location, though: carrying onto K-12 or university property, or into an establishment licensed to dispense hard liquor, is a fourth-degree felony.
